TERMS AND CONDITIONS

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“you” or “your”) and the Panhandle Aviation Alliance (“PAA,” “we,” “our,” or “us”), a 501(c)(3) nonprofit corporation organized under the laws of the State of Nebraska. By accessing or using our website, attending our events, making donations, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must immediately discontinue use of our website and services. We reserve the right to deny access to any person who violates these Terms.
PAA is a tax-exempt nonprofit organization under Section 501(c)(3) of the Internal Revenue Code, dedicated to regional aviation advocacy in Western Nebraska. Our activities include public education, statistical data publication related to Western Nebraska Regional Airport (KBFF) in Scottsbluff, Nebraska, community engagement, and policy advocacy. PAA does not operate as an aviation service provider, airport operator, or flight school, and nothing on our website or in our communications should be construed as such.
PAA grants you a limited, non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial, and informational purposes, subject to these Terms.
You agree not to:
• Use the website for any unlawful purpose or in violation of any applicable local, state, or federal law
• Reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any content from this website without PAA’s prior written consent
• Use any automated system, including bots, spiders, scrapers, or other automated means, to access the website for any purpose
• Attempt to gain unauthorized access to any portion of the website, its servers, or any connected systems or networks
• Interfere with or disrupt the integrity or performance of the website or its underlying infrastructure
• Transmit any viruses, malware, or other harmful or disruptive code
• Impersonate PAA, its board members, officers, or representatives
• Use the website to solicit, advertise, or promote commercial products or services without PAA’s prior written authorization
• Harvest, collect, or store personal information of other users or visitors
All content on the PAA website, including but not limited to text, graphics, logos, images, photographs, data compilations, statistical analyses, reports, software, and the overall design and layout of the website (collectively, “Content”), is the property of PAA or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
The Panhandle Aviation Alliance name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of PAA. You may not use such marks without the prior written permission of PAA. All other names, logos, and marks appearing on this website are the trademarks of their respective owners.
You may view, download, and print Content from this website solely for your personal, non-commercial, informational use, provided that you do not remove or alter any copyright, trademark, or other proprietary notices. Any other use of Content, including reproduction, modification, distribution, or republication, requires the express written consent of PAA.
PAA publishes statistical and economic data related to Western Nebraska Regional Airport (KBFF) and regional aviation. While PAA compiles and presents this data for public benefit, the original underlying data may be sourced from federal and state agencies, including the Federal Aviation Administration (FAA), Bureau of Transportation Statistics (BTS), and Nebraska Department of Transportation. Use of such data is subject to the terms and conditions of the originating agency. PAA’s original analyses, compilations, commentary, and presentation of such data remain the intellectual property of PAA.
PAA is a 501(c)(3) tax-exempt organization. Donations to PAA may be tax-deductible to the extent permitted by law. PAA will provide written acknowledgment of donations as required by the Internal Revenue Service. Donors are encouraged to consult their own tax advisors regarding the deductibility of contributions.
All financial transactions, including donations and event registrations, are processed through third-party payment processors. PAA does not directly collect, store, or process credit card numbers or bank account information. By making a payment, you agree to the terms and conditions of the applicable third-party payment processor.
Donations to PAA are generally non-refundable. Event registration fees may be refundable at PAA’s sole discretion. Requests for refunds of event registration fees must be submitted in writing to PAA no later than fourteen (14) days prior to the event date. PAA reserves the right to grant or deny refund requests on a case-by-case basis.
PAA will not sell, trade, or share donor personal information with any third party for their independent use, except as required by law. PAA may publish donor names in recognition materials (e.g., annual reports, event programs) unless the donor requests anonymity at the time of the contribution.
PAA may organize events, meetings, educational programs, and community activities. By registering for or attending PAA events:
• You acknowledge that you participate voluntarily and at your own risk
• You agree to comply with all applicable rules, regulations, and instructions provided by PAA and event staff
• You consent to PAA’s use of photographs, video, and audio recordings taken at events for promotional and educational purposes, unless you notify PAA in writing prior to the event that you do not consent
• You understand that PAA reserves the right to cancel, reschedule, or modify events at its sole discretion, and that PAA’s liability in such cases is limited to refund of registration fees paid, if applicable
PAA may permit users to submit comments, feedback, suggestions, testimonials, or other content (“User Content”) through our website, email, or other channels. By submitting User Content, you:
• Grant PAA a non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in any media for purposes related to PAA’s mission
• Represent and warrant that you own or have the necessary rights to the User Content and that it does not infringe upon the rights of any third party
• Acknowledge that PAA may, but is not obligated to, review, edit, or remove User Content at its sole discretion
• Agree not to submit any User Content that is defamatory, obscene, threatening, harassing, discriminatory, or otherwise unlawful
THE PAA WEBSITE AND ALL CONTENT, MATERIALS, INFORMATION, AND SERVICES PROVIDED ON OR THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PAA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
PAA does not warrant that:
• The website will be uninterrupted, timely, secure, or error-free
• The information, content, or data on the website is accurate, complete, reliable, or current
• Any defects in the website will be corrected
• The website or its servers are free of viruses or other harmful components

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PAA, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO:
• Your use of or inability to use the website or services
• Any content, information, or data obtained from or through the website

• Any other matter relating to the website or services
IN NO EVENT SHALL PAA’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE EXCEED THE AMOUNT YOU HAVE PAID TO PAA, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, PAA’S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless PAA, its directors, officers, employees, volunteers, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your use of the website or services
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any rights of a third party
• Any User Content you submit
Our website may contain links to third-party websites, resources, or services that are not owned or controlled by PAA. These links are provided for convenience and informational purposes only. PAA does not endorse, approve, or assume any responsibility for the content, products, services, or practices of any third-party websites. Access to third-party websites is at your own risk and subject to the terms and conditions of those websites.
PAA reserves the right to modify, amend, or update these Terms at any time at its sole discretion. PAA reserves the right to suspend or terminate your access to the website and services, in whole or in part, at any time and for any reason, with or without notice, including for violation of these Terms. Upon termination, your right to use the website ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4 (Intellectual Property), 8 (Disclaimer of Warranties), 9 (Limitation of Liability), 10 (Indemnification), and 14 (Governing Law).
These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict-of-law principles.
Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Scotts Bluff County, Nebraska, and you consent to the personal jurisdiction of such courts.
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting PAA using the information in Section 17. PAA will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.
PAA is committed to ensuring that our website is accessible to individuals with disabilities. We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 at the AA level. If you experience any difficulty accessing any part of our website, please contact us so we can work to provide the information you need through an alternative method.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
The failure of PAA to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of PAA.
These Terms, together with our Privacy Policy and any other legal notices or policies published by PAA on the website, constitute the entire agreement between you and PAA regarding the use of the website and services, and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral.
